The examination standard a trademark has to meet in Pakistan is the same regardless of where the applicant is based. What differs by region is which filing route makes the most sense, and a few practical considerations specific to each.

United States companies

The US is a Madrid Protocol member, so a US company with an existing USPTO registration can generally extend protection into Pakistan through a Madrid designation rather than filing a fresh national application — see our guide on how Madrid works for companies that already hold registrations abroad. Direct national filing through a local agent remains available and is sometimes simpler for a single-country need.

United Kingdom companies

The UK is also a Madrid member, and UK companies extending protection to multiple export markets alongside Pakistan are usually well served by the same Madrid designation route. Given UK-Pakistan trade ties, this is one of the more common patterns we see.

European Union companies

An EU trademark (EUTM) registered through EUIPO can serve as the basic registration for a Madrid international application designating Pakistan, letting a single EU filing extend outward without a separate application in each individual EU member state's system first.

GCC companies

Madrid membership varies across the Gulf — some GCC states are members, others are not, so the right route depends on the specific home jurisdiction. Given deepening UAE-Pakistan and broader Gulf-Pakistan trade activity, this is a growing area of our practice, and we check current membership status against the actual applicant's jurisdiction before recommending Madrid over direct filing.

What doesn't change regardless of origin

Distinctiveness requirements, the two-month opposition window once published, and the grounds for refusal under the Trade Marks Ordinance, 2001 apply identically to every applicant, foreign or domestic. Foreign applicants do need to appoint a locally qualified agent to file and prosecute the application — that requirement doesn't vary by country either.
