Extending a Foreign Trademark to Pakistan Under the Madrid Protocol

Foreign brand owners sometimes assume that designating Pakistan in a Madrid application is the end of the process. It's closer to the beginning — designation places the mark before Pakistan's Trademarks Registry for the same substantive review a mark filed directly in Pakistan would receive.

How a Pakistan designation is examined

Once WIPO notifies the Trademarks Registry of a Pakistan designation, the Registry examines it under the Trade Marks Ordinance, 2001 exactly as it would a nationally filed application — assessing distinctiveness, checking for conflicting marks already on the Pakistani register, and applying the Ordinance's own grounds for refusal. The Madrid route changes how the application arrives and how fees are paid; it doesn't change the substantive standard the mark has to meet in Pakistan.

Provisional refusal — what it means and how to respond

If the Registry has an objection — a conflicting prior mark, a distinctiveness issue, a classification problem — it issues a provisional refusal, communicated to the applicant through WIPO within the statutory examination window. A provisional refusal is not a final rejection; it's an invitation to respond, and doing so generally requires appointing a locally qualified agent to file submissions with the Registry directly, since the response itself falls outside WIPO's role. Missing the response deadline, on the other hand, can allow the refusal to become final by default — so early instruction of local counsel once a provisional refusal issues matters more than clients sometimes expect.

Opposition once published

If the Registry has no objection, or once an objection is overcome, the mark is published in the Pakistani Trademarks Journal, opening the same statutory opposition window that applies to any other application — currently a defined period during which third parties can file opposition on Form TM-5. A Pakistan designation is exposed to opposition on exactly the same footing as a directly filed application; Madrid doesn't provide any additional insulation from a competitor or prior rights holder challenging the mark locally. Madrid designation vs filing directly in Pakistan

For a foreign owner already holding an international registration or planning multi-country coverage, designating Pakistan alongside other territories is usually the more efficient route — one set of renewal deadlines, one international record, lower incremental cost per additional country. For an owner whose interest is Pakistan specifically, with no broader multi-country filing underway, direct national filing through a local agent can be simpler and, in some cases, faster to get moving, since it isn't queued behind WIPO's formal examination stage first.
