Benelux Trademark Registration: Why Belgium, Netherlands and Luxembourg Are One Filing
Belgium, the Netherlands and Luxembourg have no national trademark offices. A trademark covering any one of them is a Benelux trademark filed at the BOIP, covering all three — there is no Netherlands-only or Belgium-only option.
This is the one genuine regional sub-system inside the EU, and it surprises people: you cannot register a trademark in the Netherlands alone. There is no office to do it at.
The structural quirk most guides get wrong
Belgium, the Netherlands and Luxembourg abolished their separate national trademark registries and replaced them with a single shared institution — the Benelux Office for Intellectual Property (BOIP). As the EUIPO puts it, if you want protection in Belgium, the Netherlands and/or Luxembourg, you apply at the BOIP, which handles trade mark applications for all three countries together. Applying for one means covering all three. There is no smaller unit available.
Benelux versus a full EUTM
A Benelux registration covers three countries; a EUTM covers twenty-seven including those three. If the Benelux region is genuinely your entire European market — which it is for some exporters, given Rotterdam and Antwerp's role as entry ports for goods arriving from Pakistan — a Benelux filing is meaningfully cheaper than an EU-wide one and carries less opposition exposure, since only earlier Benelux rights can be raised against it rather than earlier rights from any of 27 states.
When Benelux-only makes sense
Chiefly when the commercial footprint is genuinely limited to those three markets, or as a deliberate first step before wider EU expansion. It is also sometimes the sensible fallback where a clearance search reveals a conflicting earlier right elsewhere in the EU that would likely defeat a full EUTM application but has no presence in the Benelux territory.
Practical notes for Pakistani exporters
Given that a great deal of Pakistani textile and goods trade enters Europe through Dutch and Belgian ports, brand protection in the Benelux region is often more commercially urgent than its small geographic size suggests — goods clear customs, are warehoused, and are distributed onward from there. A Benelux designation is also available through the Madrid Protocol, so it can sit inside a wider international application rather than needing a standalone filing.
